Drinking alcohol while driving – new law

From 14 December 2011 it is an offence to drink alcohol while:

  • driving a motor vehicle
  • sitting beside a person who is learning to drive.

There is no need for any alcohol to be detected in the person's blood or breath.

Penalties

The maximum penalty is ten penalty units.

If the matter is dealt with by issuing a fine (infringement notice), the penalty is two penalty units.
