Procedure regarding equitable charges

Practitioners are reminded that when your client has been asked to sign an equitable charge as a condition of their grant of legal assistance, the signed original must be returned to us.

Practitioners are reminded that when your client has been asked to sign an equitable charge as a condition of their grant of legal assistance, the signed original must be returned to us. We cannot accept a photocopy or scanned copy.

To ensure that we can accept the charge, please:

  • complete the form using blue pen
  • ensure the name of the witness is legible
  • print the form that we have sent to you specifically for your client.

Although we will send you a blank form for completion with your client’s details, the top of the form contains your client’s file reference number. It is important that we receive the signed charge with the relevant file reference number on it as this ensures that the client is giving permission for the costs to be secured against that particular file.
